The Chongqing Municipal Development and Reform Commission recently issued “Certain Measures to Encourage Foreign-Invested Enterprises to Reinvest in China”, which proposes 16 policy measures in three dimensions: guiding foreign investment, facilitating investment and operation, and raising the level of protection in accordance with the principle of unity of domestic and foreign investment. The “Measures” suggest supporting foreign-invested enterprises to use industrial land such as industry, logistics and warehousing using appropriate methods such as long-term leasing, leasing first and later, and flexible tenure, taking into account their own reality. Where land is supplied through leasing or flexible tenure concession, the lease period and concession period can be flexibly set according to the wishes of the enterprise. If industrial land needs to be continued to be used even after the flexible concession period expires, apply for renewal in accordance with law and regulations within the maximum legal period.
