Nykode Therapeutics Gets Unfavorable Tax Appeal Board Ruling, Plans to Seek Review

12:54 AM EDT, 09/28/2026 (MT Newswires) -- Nykode Therapeutics (NYKD.OL) said Sept. 25 it received an unfavorable ruling from Norway's Tax Appeal Board in its dispute over the tax treatment of upfront payments under a 2020 license agreement for its VB10.NEO program. The biopharmaceutical company said the ruling went against the board secretariat's recommendation. The board agreed with Nykode on the main issue in dispute, but reclassified VB10.NEO as an asset developed for sale rather than an operating asset, a basis not previously raised in the case. Nykode said it plans to ask the board to reconsider and expects to contest the outcome in court if the decision stands. It noted that the ruling will not affect the company's current plans, nor will it trigger additional payments, since it settled the disputed tax amount in 2023.
