The reporter learned today that the General Administration of Market Regulation has studied and drafted the “Food Safety Law of the People's Republic of China” and solicited public comments. The main elements of the revision include five aspects: the first is to strengthen smart supervision. Promote the application of “Internet+Artificial Intelligence” supervision, make it clear that food production and management enterprises should install surveillance equipment in key risk areas of food production and operation, and connect real-time surveillance video information to the information systems of market supervision and administration departments of local people's governments at or above the county level; give supervisory authorities off-site inspection powers such as IoT monitoring and video inspection. The second is to consolidate principal responsibilities. It is stipulated that food production and management enterprises and online food trading platform operators shall be equipped with food safety directors and food safety officers in accordance with regulations, clarify job responsibilities, and strengthen training and assessment; require food production enterprises to establish a food production process control record system; establish real-name receipt and delivery, inspection, and transit safety inspection systems for postal express delivery companies; standardize outsourced production practices and clarify the qualifications of clients and trustees. The third is to strengthen supervision in key areas. A special section on “School Food Safety” was added, a principal responsibility system was established, and a centralized meal companion system for primary and secondary schools and kindergartens was established; a “Internet Food Management” section was added to implement hierarchical filing management to clarify the main responsibilities of all parties such as platforms, live broadcast room operators, live streaming marketers, etc.; and clarify that cross-border e-commerce enterprises assume the main responsibility for the safety of food, food additives, and food-related products imported from cross-border e-commerce. Fourth, optimize the food safety management system. Expand the scope of food safety risk monitoring to food additives and food-related products; include complementary foods for infants and young children in special food supervision and implement filing management; standardize food labeling and commercial publicity, strictly prohibit false and misleading; strictly manage food inspection and standardize commissioned inspection practices. The fifth is to improve the legal liability system. Set differentiated penalties according to the type of violation; strictly implement “punish people”; punish those responsible for intentionally breaking the law, being egregious in nature, and causing serious consequences; complete penalty clauses corresponding to the new obligations to raise the cost of breaking the law; implement a food safety credit management system, and implement cross-departmental punishment for loss of trust.
